Owner-Operator DOT Compliance FAQ
Do I need a random testing consortium if I am the only driver?
Yes. A driver who needs a CDL must be in a random drug and alcohol testing program, and a single-driver operation cannot run its own random pool. A consortium places you in a larger pool of drivers so selections are genuinely random, and a third-party administrator keeps the records.
What is the FMCSA Clearinghouse, and do I have to register?
The Clearinghouse is the federal database of CDL drug and alcohol violations. An owner-operator who employs themselves is both employer and driver, so you register as an employer, designate a consortium or third-party administrator to report for you, and run a pre-employment full query and an annual query on yourself.
I am leased on to a carrier. Do I still need my own program?
It depends on whose authority you run under. Leased owner-operators are often included in the carrier’s testing program, so confirm that with the carrier in writing. If you operate under your own authority, the responsibility is yours. Best practice is maintaining these under your DOT authority so you are more attractive to employers looking to use your services.
What do I need in my driver qualification file?
Generally an employment application, motor vehicle record, road test or CDL equivalent, medical examiner’s certificate, and previous-employer checks, with annual reviews on file. Our team builds and maintains the file so it is ready if you are audited.
Do drivers without a CDL need drug testing?
DOT drug and alcohol testing applies to drivers who are required to hold a CDL. Non-CDL trucks can still be subject to other DOT requirements such as driver files and vehicle records. Call us and we will tell you what applies to your operation.
How much does it cost and how long does it take?
Pricing depends on how many drivers you have and which services you need, so request a quote and you will see the price before you commit. There are no contracts and no minimums, and accounts are typically ready within 24–48 hours.
