Three questions to ask about your hiring

Are you using AI/AED in hiring?

Resume scoring, candidate ranking, screening chatbots, or assessment and video scoring tools, including features built into your ATS.

Are you hiring in multiple states?

Or in one of the 20+ states with AI hiring laws enacted or pending?

Are you hiring remote applicants?

Remote candidates bring their state's rules with them, wherever your company is based.

Answered yes to any of these? You likely have AI hiring compliance obligations.

The rules are already here

These laws follow the candidate's location, not your headquarters.

New York City

In effect since 2023

Annual independent bias audit of each tool, posted results, and advance notice to candidates (Local Law 144).

Penalties: up to $500 for a first violation and $500 to $1,500 for each one after. Every day a tool is used without a current audit, and every missed notice, counts as a separate violation.

California

In effect since October 2025

Automated decision systems are covered by state anti-discrimination law.

Penalties: no set fine. Exposure comes through discrimination claims, which can bring back pay, uncapped compensatory and punitive damages, and attorney's fees.

Illinois

In effect since January 2026

No discriminatory use of AI in employment decisions, and workers must be told when AI is used.

Penalties: civil penalties of up to $16,000 to $70,000 per violation, depending on prior violations, plus actual damages and attorney's fees.

Colorado

Starts January 1, 2027

Notice, disclosure, records, and human review when automated tools materially influence hiring.

Penalties: up to $20,000 per violation, enforced by the attorney general. First-time violations get 60 days to fix the problem before penalties apply.

More states have bills pending. For employers recruiting in Europe, the EU AI Act's hiring rules apply from December 2027, with fines of up to €15 million or 3% of worldwide revenue.
